FAQs

When do my rights to preserve a lien expire?

This depends on whether you are a contractor, subcontractor, or supplier. Unless preserved, a contractor’s lien rights will expire 45 days after the day the declaration/certificate of substantial performance is published, the contract is completed, or the contract is abandoned, whichever is earliest. The lien rights of subcontractors and suppliers will expire, unless preserved, 45 days after the date on the declaration/certificate of substantial completion, the date on which the person supplied materials or services, or the date on which the subcontract was certified to be complete, whichever is earliest.
