What is the difference between a trade name and a trade-mark?

A trade name is simply the name under which you conduct your business. A trade-mark is a mark used in association with your goods and services to distinguish your goods or services from those of others. For example, your business name might be “123 Incorporated”. If you produce hamburgers under the name “Waldo’s World Famous Hamburgers” and you want to register a trade-mark, you would apply to have “Waldo’s World Famous Hamburgers” registered as a trade-mark in connection with that product because it is the name by which the public knows your product and is therefore an important part of the goodwill that may comprise a significant part of the value of your business.
