I’ve recently entered into a distributorship arrangement with a company that will promote its services using my trade-marks. What protections should I build into my distributor arrangement?

Your supplier/distributor agreement should contain the appropriate provisions relating to the supplier’s use of your trade-marks. These provisions vary in scope, but typically involve controls such as how and when the supplier/distributor can use your trade-marks, and how you can monitor and inspect the supplier’s use of your trade-marks. Failure to impose controls protecting your trade-marks can jeopardize their validity and in some cases lead to your trade-marks being expunged (deleted or removed) as trade-marks.
