Probate tax (formally called estate administration tax) is calculated on the value of the estate being probated. The tax is $5 per $1,000 of value on the first $50,000 and $15 per $1,000 for any amount in excess of $50,000. If an estate that is included in probate is worth $1 million, the estate would pay $14,500.00 in probate tax.
