Dennis Kish is an associate in Lawrences' Bankruptcy & Insolvency Group. He has comprehensive knowledge of Canadian and U.S. insolvency and creditors' rights, having practiced law in both the U.S. and Canada. Dennis has significant experience representing both debtors and creditors, and has managed insolvency files for a firm of bankruptcy trustees. He has also represented most of the largest financial institutions in the U.S., protecting their creditors' rights in U.S. insolvency proceedings.

SIGNIFICANT CASES

On behalf of a firm of bankruptcy trustees, successfully managed a large portfolio of Division I proposals and ordinary administration bankruptcies, including those of small corporations, owner-managed businesses, doctors, dentists, accountants and many other professionals with complex financial situations. Regularly attended before the Registrars and Justices of the Superior Court of Justice.
On behalf of a U.S. bank, set aside a judgment that avoided the bank's security in real property under the "Strong Arm" provisions of the U.S. Bankruptcy Code, thereby allowing the bank to make an insurance claim with its title insurance carrier and settle the matter at no loss to the bank.
On behalf of a U.S. bank, drafted the appellate materials in the successful appeal to the Federal Court for the Eastern District of Michigan of a Bankruptcy Court decision, thereby allowing the bank to receive the funds it was entitled to receive in a U.S. insolvency proceeding.
On behalf of a bankrupt, conducted extensive legal research and uncovered case law that was pivotal in winning an adversary proceeding to set aside a foreclosure sale and allow the bankrupt to retain her residence in a U.S. bankruptcy proceeding.
