Certified as a Specialist in Civil Litigation, Ken's practice is focused on corporate and commercial litigation, with particular expertise in contractual disputes, shareholder and partnership disputes, professional negligence matters and real estate, including condominium litigation, commercial landlord and tenant disputes, enforcing and defending foreign judgments and debt enforcement.
Ken has extensive trial and appellate experience before all levels of court in Ontario, with over 90 reported cases. He is also on the LawPro list of approved defence counsel. Ken practised law in downtown Toronto for 21 years before joining Lawrences in 2004.

SIGNIFICANT CASES

The Issue: Bank Defrauded with Counterfeit Cheque

The Approach:
• Immediately issue and serve Statement of Claim and obtain injunction freezing defendants' accounts.

The Result:
• As a result of the injunction, the Bank was completely indemnified by the defendants in just over one week from discovering the fraud.

The Issue: Condominium developer sued by numerous purchasers

The Approach:
• Purchasers were alleging non-compliance with Condominium Act and attempting to back out of agreements to purchase.
• Examined all of the purchasers, showed that issue of non-compliance was immaterial: real reason for situation was falling real estate market.

The Result:
• In precedent-setting decision, Ontario Court of Appeal dismissed claim and established which breaches of legislation allow purchasers to back out of real estate transaction.

The Issue: Law firm seeking creditor priority over banks

The Approach:
• Law firm had unpaid legal accounts and sought creditor priority over banks. If banks had priority, law firm would not be paid. Brought application for law firm based upon seldom-used legal principle on agreed facts.

The Result:
• In precedent-setting decision, law firm was given priority over banks, and accounts were paid in full.
